'The Relation Between Corporate Information Rights and Non-Compete Clauses Based on the Example of an Equal Participation GmbH & Co. KG': This thesis examines the tension between a shareholder's individual rights to information and a shareholder's non-compete obligation based on the example of an equal participation GmbH & Co. KG. It shows that the comprehensive access to information of a GmbH shareholder (§ 51a GmbHG) triggers the non-compete obligation for limited partners (§ 117 HGB). This non-compete protects the company from abstract conflicts of interest that could threaten its existence. The partnership agreement should contain clear provisions on this in order to avoid legal uncertainties and ensure ongoing commercial cooperation.
